                Dear Member, 

                Please find below our Chamber's 1- Registration Fee, Annual Contribution, 2- Supplementary Contribution, 3- Fees to be collected from Ships, 4- Fee Tariff for Services Provided, and 5- Fee Tariff of Document Charges came into force with the 20.12.2018 dated and 9 numbered approval of the Assembly of the Chamber and prepared according to the Article 24, 25, 26 of the Law No. 5174 of the Union of Chambers and Commodity Exchanges of Turkey and which will be implemented as from 01.01.2019.

 

  1. 1) REGISTRATION FEE AND ANNUAL CONTRIBUTION TARIFF

  3.              Article 24 of the Law No. 5174, and the Article 5 of the Regulations of Annual Contribution related to the Registration Fee state; "The fee, which must be paid by the member during the registration to the Chamber or to the Commodity Exchanges is referred as the Registration Fee and the annual contribution, which he/she will pay per year, Annual Contribution. The members are obliged to pay the registration fee during the registration to the Chamber or Commodity Exchanges and they have to pay Annual Contribution per year. "

·  The Chamber Registration Fees are collected in cash during the registration.

·  The annual contribution is collected in two equal installments in JUNE and OCTOBER.

 

  1. 2) SUPPLEMENTARY CONTRIBUTION TARIFF

Article 25 of the Law No. 5174, and the Article 6 of the Regulations of Determination and Payment of Annual Contribution related to the Registration Fee state,  " The Supplementary Contribution would be collected by the Chambers in the rate of five per thousand over total of commercial revenue of real entities and industrialists that is shown in their statements related to the Income Tax and over the commercial balance-sheet profit of the legal entities and industrialists that is shown in the statements related to the corporate tax per annum." 

·     The supplementary contributions of those, who are registered to more than one Chamber, are paid by the member to the relevant chambers by dividing them in equal proportions

·       The members in loss do not pay the supplementary contribution for that year. 

·       The supplementary contribution of the members, who have more than one office within the work areas, is calculated over the commercial revenue or commercial balance-sheet profit which is basis for accrual for the corporate tax or over the revenue that they earn from all offices. 

·    The supplementary contribution to be paid by an enterprise with the offices and plants shall not exceed the twenty folds of annual contribution ceiling which is determined for that year. 

·      Our members, who are registered to more than one Chamber, must document and submit the other chambers' memberships to our Chamber. Accordingly, the supplementary contribution of the Chamber of Shipping shall be accrued by dividing the accrual by the documented and valid number of chamber membership. 

·       The supplementary contribution is collected in two equal installments in JUNE and OCTOBER

  1. 3) FEES TO BE COLLECTED FROM THE SHIPS
        1.       3-1  PORT SERVICE FEE TO BE COLLECTED FROM THE TURKISH FLAGGED SHIPS

According to the subparagraph (s) of the Article 26 of Law No. 5174, based on the provision: "Common and international sector services to be provided to the Turkish or foreign flagged ships," and in the last paragraph, "the fees against the services or certification should be collected by the Turkish Chamber of Shipping from the Turkish and foreign flagged ships not more than fifteen days from the service or certification"; 

The Port Service Fee is collected from the ships which enter to the ports and port area within the activity field of our Chamber for Loading/Unloading, Transit Procedure or Repairing, Maintenance/Repairing, Survey, Supply and Waiting according to the below listed GROSS TON range, according to the Port Departure Document issued by the Ministry of Transport and Infrastructure.

* EXEMPTION AND EXCEPTIONS

  1. a)      The Port Service Fee is not collected from the FISHING boats.

    b)       The Port Service Fee is not collected from the ships which are determined by the Ministry of Transport and Infrastructure as the SERVICE ship. (The kinds of ships stated under the term Service Ship have been published on our WEB site.)

    c)       The Port Service Fee is not collected from the ships which provide the education and research services.

    d)       The Port Service Fee is not collected from the ships that come into the port for crew change, provided that they shall certificate it by furnishing the letter from the Ministry of Transport and Infrastructure.

    e)       The Port Service Fee is not collected from Passenger Ships, Cruise Type Passenger Ships, River / Sea Type Passenger Ships, (Catamaran Type) Passenger Ships, High Speed Light Passenger Ships, Pleasure Boats and Passenger Motor Vessels after 24 cruises at the same port within the same year.

    f)         The Port Service Fee is not collected from the ships which belong to the public and being operated by the public institutions and foundations.

    g)       70, 00 TL of Port Service Fee is collected from the Bunker Tankers between 0 – 500 Gross Ton. 

    ·  For the above listed exemptions and exceptions, the data of Port Departure Document issued by the Ministry of Transport and Infrastructure is considered as basis. 

    ·  The Port Service Fee that is collected from the Turkish flagged ships should be paid by themselves, by their representatives or agents in cash to the Turkish Chamber of Shipping within the relevant port area within 15 (fifteen) days from the date when the ship departs from the port.

  2.     3-2 PORT SERVICE FEE TO BE COLLECTED FROM THE FOREIGN FLAGGED SHIPS

  3.   1. * EXEMPTION AND EXCEPTIONS
    • a)       The Port Service Fee is not collected from the ships which are determined by the Ministry of Transport and Infrastructure as the SERVICE ship. (The kinds of ships stated under the term Service Ship have been published on our WEB site.)

      b)      The Port Service Fee is not collected from the ships which provide the education and research services.

      d)      The Port Service Fee is not collected from Passenger Ships, Cruise Type Passenger Ships, River / Sea Type Passenger Ships, (Catamaran Type) Passenger Ships, High Speed Light Passenger Ships, Pleasure Boats and Passenger Motor Vessels after 24 cruises at the same port within the same year. 

      · For the above listed exemptions and exceptions, the data of Port Departure Document issued by The Ministry of Transport and Infrastructure is considered as basis. 

      · The Port Service Fee, collected from the Foreign Flagged ships, should be paid by the primary agent in Turkey in cash to the Turkish Chamber of Shipping within the relevant port area within 15 (fifteen) days from the date when the ship departs from the port.

  2.  

    •    3-3 FEE TARIFF OF CHAMBER SHARE FROM THE FREIGHT REVENUE 
    • According to the provision of the last paragraph of Article 25 of the Law No. 5174, "The amount to be suggested by the Chamber's Board of Directors and to be calculated according to the rate to be determined by the Chamber's Assembly shall be paid within 15 days of the departure from port of the ship, by themselves, by their representatives or agents to the Turkish Chamber of Shipping in the relevant port area or Chamber of Commerce or Chamber of Commerce and Industry in the locations where the Turkish Chamber of Shipping is not available over all freight revenues which the foreign flagged ships that are not registered in any chamber in Turkey, and the Turkish flagged ships that are operated by the real or legal entities who are located in a foreign country acquire from taking cargo from or bringing cargo to the Turkish ports, and from the Cruise and Passenger ships over the gross ton considering the international application, provided that it would not exceed five per thousand and annual supplementary contribution ceiling," Chamber's Share Fee from the Freight revenue is collected.

       

      a)      CONTAINER AND RO-RO SHIPS :

      The Chamber's Share Fee from the Freight revenue is collected from the foreign flagged ships which take cargo from or bring cargo to the Turkish ports and from the Turkish flagged Container and RO-RO ships and etc. ships that carry goods over piece which are chartered to the foreigners over all freight revenues individually that they acquire from LOADING and UNLOADING, provided that;

      -   It would not exceed five per thousand (‰ 5);

      -   It would not exceed 550 US Dollars in the import and export cargoes,

      -   In the event that both loading and unloading of the same ship are declared by the same agent in the same port and same voyage, instead of 550+550=1.100 $, the Chamber's Share Fee from the Freight revenue is collected as 412,5+412,5=825 $, on condition that it would not exceed it. 

      b)     DRY CARGO, LIQUID CARGO AND BULK CARGO SHIPS:

      The Chamber's Share Fee from the Freight revenue is collected from the foreign flagged ships which take cargo from or bring cargo to the Turkish ports and from the Turkish flagged Dry Cargo, Liquid Cargo and Bulk Cargo Ships which are chartered to the foreigners over all freight revenues individually that they acquire from LOADING and UNLOADING according to the below listed rates, provided that it would not exceed five per thousand (‰ 5).

  • - In the event that both loading and unloading of the same ship are declared by the same agent in the same port and same voyage, the discounted Chamber Share Fee from the Freight revenue is collected according to the below table.

- In the event that the tonnage of loading and unloading of the same ship are different by the same agent in the same port and same voyage, the discount rate shall be applicable considering the higher tonnage range.

The Chamber's Share Fee from the Freight Revenue is collected from all Foreign flagged and Turkish flagged Passenger Ships, Cruise Type Passenger Ships, River/Sea Type Passenger Ships, (Catamaran Type) Passenger Ships, High Speed Light Passenger Ships, Pleasure Boats and Passenger Motor Vessels that are chartered to the foreigners and visit Turkish ports over the below indicated gross ton per visit.

- The exception for after 24 cruises that is applicable for all Passenger Ships, Cruise Type Passenger Ships, River/Sea Type Passenger Ships, (Catamaran Type) Passenger Ships, High Speed Light Passenger Ships, Pleasure Boats and Passenger Motor Vessels to the same port within the same year is for the Port Service Fee and not valid for the Chamber's Share Fee from Freight Revenue. 

  • * For the above listed exemptions and exceptions, the data of Port Departure Document issued by the Turkish Ministry of Transport, Maritime Affairs and Communications is considered as basis.
  • * The fees in Dollar, indicated in the Tariff of Chamber's Share from Freight Revenue, shall be paid by calculating the amount of foreign exchange against Turkish Lira in the Turkish Central Bank's exchange rate for US Dollar on the date when the ship departs (leaves).

* The Chamber's Share Fee from Freight Revenue should be paid by the primary agent and if any, by other agents in cash to the Turkish Chamber of Shipping within the relevant port area within 15 (fifteen) days from the date when the ship departs from the port.

 

d) GENERAL APPLICATION PRINCIPLES OF CHAMBER'S SHARE FEE FROM FREIGHT REVENUE :

  1. 1)   Liability of Primary Agent: The final responsibility for the payments related to the Loading and Unloading Procedures per Port Departure Document that is notified by the Ministry of Transport and Infrastructure is assumed by the Primary Agent. Primary Agent may request from other agents to make their own payments. The accrual from the Loading and Unloading Procedures that the due amount is not paid related to the Port Departure Document due to which other agents do not make the payments that they are liable for shall be debited to the primary agent

    2)  Manifest Correction: In the event that the Loading and Unloading data, available in the Port Departure Document from the Ministry of Transport and Infrastructure and manifests made by the member agents to the Turkish Chamber of Shipping are different, the primary agent shall be responsible for correction of data by the Port Departure Document and for notifying the correction to the Turkish Chamber of Shipping.  

    3)  From Foreigner to Foreigner:  The primary agent shall be responsible for submitting the approved certificate from the port customs administration to the Turkish Chamber of Shipping and for demanding the exemption for the Loading and Unloading procedures in order that the cargoes, which are not stated as TRANSIT cargo in the Port Departure Document, but are transported from one foreign port to another, are subjected to the Chamber's Share Fee exemption from Freight Revenue under the scope of TRANSIT application. 

    4)   Transit Transport:  It refers the temporary unloading of cargoes which depart from the foreign port and finally would be transported to the foreign port, to the Turkish port due to any reason and reloading of them to the ship. Because of this, since the unloading of cargoes from abroad to a Turkish port in order to transport to another Turkish port is not within the scope of TRANSIT exemption, the Chamber's Share Fee from the Freight Revenue from such Loading and Unloading procedures related to these transports shall be declared by the primary agent of it at the first port where the cargo is unloaded. 

    5)  Ex-Officio Accrual (for the Marine Vessels, Except the Container Ship):  For the Loading and Unloading operations which their Chamber's Share Fee from the Freight Revenue is not declared to our Chamber until the end of month following the departure date of ship, indicated in the Port Departure Document, the Ceiling Fee amount of the degree, corresponding to the transport weight in this year's price tariff, shall be debited to the ship's primary agent as the ex-officio Chamber's Share Fee from the Freight Revenue. 

    6)    Ex-Officio Accrual (for Container Ships):  For the Container Loading and Unloading operations which their Chamber's Share Fee from the Freight Revenue is not declared to our Chamber until the end of month following the departure date of ship, indicated in the Port Departure Document, 5 $ (five US Dollars) per container unit, indicated in the Port Departure Document, shall be debited to the ship's primary agent as the ex-officio Chamber's Share Fee from the Freight Revenue. If the number of containers in the Port Departure Document is 100 and more, then the Ceiling Fee, shall be debited to the ship's primary agent as the ex-officio Chamber's Share Fee from the Freight Revenue. 

    7)    Declaration and Documentation: The Turkish Chamber of Shipping may request the document which proves the freight amount that is declared by the ship's agent in the "Freight Declaration Form". 

    8)    Container Cargo Declaration Procedures :  In container ships, the Primary Agent (the agent shown on Port Departure Document), for the loading/unloading cargo procedures, other than its own cargoes and belonging to the other agents, within fifteen days (15)  after the date  of departure of the ship, should declare to the Turkish Chamber of Shipping (İMEAK DTO) the loading/unloading cargo amounts which belong to the other agents,  by completing "The Container Cargo Details Declaration Form".

  3.    3-4 PRICE TARIFF TO BE COLLECTED FROM THE TURKISH AND FOREIGN FLAGGED YACHTS 

  4. According to the subsection (s) of the Article 26 of Law No. 5174, based on the provision "Common and international sectoral services to be provided to the Turkish or foreign flagged ships"; 

    Sector Service Share Fee is collected from the Yachts which enter to the ports and marinas within the activity field of our Chamber per departure according to the below listed gross ton range.

  • 4)  FEE TARIFF FOR SERVICES PROVIDED
  •         The ceiling amount of Fees and Charges that are collected by our Chamber in return for services provided is restricted based on the annual contribution limit which is determined by the 26th article of the Law No.5174 of the TOBB. The tariff below stated will be used for charges and fees that will be collected by our Chamber for services provided.

- The ceiling amount to be collected per service and document, listed in the item 4, "FEE TARIFF FOR SERVICES PROVIDED" of the price list, is 650,00 TL.


5)      FEE TARIFF FOR DOCUMENT CHARGES 

According to the tariff of drawing up document and service fees, the tariff stated below will be implemented for fees of the documents provided by our Chamber.

8- Approval Charge for Industrialist Certificate 100,00 TL
9 - Credentials for Visa  100,00 TL
10 - Credentials (in the requests after the 1st request) 100,00 TL
11 - Domestic Goods Certificate 200,00 TL
12 - Customs Procedure Follow-Up Card 75,00 TL
13 - Charges of Other Documents 100,00 TL

 

·        The fees, listed in the item 5, "FEE TARIFF FOR DOCUMENT CHARGES" of the price tariff, are collected in cash. 

·         The ceiling amount to be collected per service and document, listed in the item 5, FEE TARIFF FOR DOCUMENT CHARGES" of the price list, is 650,00 TL.
