tarafından Odamıza g&ouml;nderilen&nbsp;09.06.2026&nbsp;tarihli ve&nbsp;122908536 sayılı yazıda,&nbsp;<u>Odamızın 06.03.2026 tarihli 624 sayılı yazısına istinaden</u>; 2012/02 sayılı &Ouml;zet Beyan Uygulaması hakkındaki Genelge meyanında &Uuml;yelerimizden Odamıza yapılan m&uuml;racaatlarda, &ouml;zet beyan eksiklik/fazlalık takibatları ile ilgili olarak &uuml;&ccedil; aylık takibat s&uuml;resi i&ccedil;erisinde noksanlık ve/veya fazlalığın neden kaynaklandığına ilişkin getirilen mahre&ccedil; yazılarının ilgili g&uuml;mr&uuml;k idarelerince uygun bulunmamasından m&uuml;tevellit cezaların tatbik edildiği, ilgili acentelere yazılı olarak bu konuda herhangi bir tebligatta bulunulmadığı ve buna m&uuml;teallik yapılan itirazların da g&uuml;mr&uuml;k idarelerince kabul edilmediği hususlarına da yer verilerek konunun değerlendirilmesinin talep edildiği ifade edilmektedir.</p> <p style="text-align: justify;">Odamızın yazısı ve girişimleri sonucunda G&uuml;mr&uuml;kler Genel M&uuml;d&uuml;rl&uuml;ğ&uuml;nce talebimize ilişkin yapılan değerlendirme neticesinde; Gazete'de yayımlanarak y&uuml;r&uuml;rl&uuml;ğe girmiştir.</p> <p style="text-align: justify;">Kanun ile; kamu alacaklarında tecil s&uuml;resinin uzatılması, &uuml;retim ve zirai faaliyet kazan&ccedil;ları i&ccedil;in indirimli kurumlar vergisi uygulanması, transit ticaret ve nitelikli hizmet merkezi kazan&ccedil;larına y&ouml;nelik vergi indirimleri, yurt dışı kazan&ccedil; ve iratlar i&ccedil;in gelir vergisi istisnası, nitelikli hizmet personeline &uuml;cret istisnası ve varlıkların ekonomiye kazandırılmasına ilişkin d&uuml;zenlemeler yapılmıştır.</p> <p style="text-align: justify;">Bu Kanun kapsamında;</p> <p style="text-align: justify;">1- Kamu alacaklarında tecil s&uuml;resi 36 aydan 72 aya &ccedil;ıkarılmış, teminatsız tecil tutarı ise 50.000 TL'den 1.000.000 TL'ye y&uuml;kseltilmiştir.</p> <p style="text-align: justify;">2- Gelir Vergisi Kanununun m&uuml;kerrer 20/D maddesi kapsamındaki kişiler i&ccedil;in veraset yoluyla mal intikallerinde, veraset ve intikal vergisinin %1 oranında uygulanması d&uuml;zenlenmiştir.</p> <p style="text-align: justify;">3- Teknogirişim şirketlerince &ccedil;alışanlara verilen pay senetlerinde gelir vergisi istisnasına esas tutar, ilgili yıldaki br&uuml;t &uuml;cret tutarının iki katı olarak belirlenmiş ve bu pay senetlerini elde tutma s&uuml;relerine bağlı vergileme h&uuml;k&uuml;mleri yeniden d&uuml;zenlenmiştir.</p> <p style="text-align: justify;">4- Son &uuml;&ccedil; takvim yılında T&uuml;rkiye'de yerleşik olmayan ger&ccedil;ek kişilerin T&uuml;rkiye dışında elde ettikleri kazan&ccedil; ve iratlar 20 yıl s&uuml;reyle gelir vergisinden istisna edilmiş, bu kazan&ccedil;lar i&ccedil;in beyanname verilmemesi, gider indirimi yapılmaması ve yurt dışında &ouml;denen vergilerin mahsup edilmemesi &ouml;ng&ouml;r&uuml;lm&uuml;şt&uuml;r.</p> <p style="text-align: justify;">5- Nitelikli hizmet merkezlerinde istihdam edilen personelin &uuml;cretlerinin br&uuml;t asgari &uuml;cretin &uuml;&ccedil; katına kadar olan kısmı gelir vergisinden istisna edilmiştir.</p> <p style="text-align: justify;">Belirli end&uuml;stri b&ouml;lgeleri ile İstanbul Finans Merkezinde bu sınır beş kat olarak uygulanacaktır.</p> <p style="text-align: justify;">Ayrıca, nitelikli hizmet merkezlerinin yurt dışından elde ettikleri kazan&ccedil;ların %95'inin kurumlar vergisi matrahından indirilebilmesine imkan tanınmış, belirli b&ouml;lgelerde bu oran %100 olarak belirlenmiştir.</p> <p style="text-align: justify;">En az &uuml;&ccedil; &uuml;lkede faaliyet g&ouml;steren ve gelirinin en az %80'ini yurt dışından elde eden şirketler nitelikli hizmet merkezi kapsamında değerlendirilecektir.</p> <p style="text-align: justify;">6- Yurt dışından satın alınan malların T&uuml;rkiye'ye getirilmeksizin satılmasından veya bu işlemlere aracılıktan elde edilen kazan&ccedil;ların %95'inin kurumlar vergisi matrahından indirilebilmesi imkanı getirilmiştir. Belirli b&ouml;lgelerde bu oran, %100 olarak uygulanacaktır.</p> <p style="text-align: justify;">7- Sanayi sicil belgesine haiz ve fiilen &uuml;retim faaliyetiyle iştigal eden kurumların &uuml;retim faaliyetlerinden elde ettikleri kazan&ccedil;ları ile zirai &uuml;retim faaliyetlerinden elde ettikleri kazan&ccedil;lar i&ccedil;in kurumlar vergisi oranı %12,5 olarak belirlenmiştir.</p> <p style="text-align: justify;">Ayrıca, transit ticaret, nitelikli hizmet merkezi ve İstanbul Finans Merkezi kapsamında sağlanan kazan&ccedil; indirimlerinin asgari kurumlar vergisi matrahından d&uuml;ş&uuml;lebilmesine imkan tanınmıştır.</p> <p style="text-align: justify;">8- Yurt dışında bulunan para, altın, d&ouml;viz, menkul kıymet ve diğer sermaye piyasası ara&ccedil;ları ile T&uuml;rkiye'de bulunmakla birlikte kayıtlarda yer almayan aynı nitelikteki varlıkların 31.07.2027 tarihine kadar bildirilmesine imkan tanınmıştır.</p> <p style="text-align: justify;">Bildirilen varlıkların kanuni defterlere kaydedilmesi, belirli şartlarla &ouml;zel fon hesabında izlenmesi ve d&uuml;zenlemeden m&uuml;kellef olmayan kişilerin de yararlanabilmesi &ouml;ng&ouml;r&uuml;lm&uuml;şt&uuml;r.</p> <p style="text-align: justify;">Bildirilen varlıklar &uuml;zerinden genel olarak %5 vergi alınacak; elde tutma s&uuml;resine bağlı olarak bu oran %0 ila %4 arasında uygulanabilecektir. Lojistik Dairesi Başkanlığı'ndan alınan E-454925 sayılı ekte sunulan yazıda; Kurumlarının ihracat sevkiyatlarını ger&ccedil;ekleştirmek &uuml;zere gemi kiralama yoluyla, deniz taşımacılığı konusunda ihtisaslaşmış firmalardan, navlun teklifi toplanmakta ve en uygun teklifi veren firmadan deniz yolu taşıması hizmeti almakta olduğu, s&ouml;z konusu hizmet alımına dair yasal zorunluluk olan damga vergisinin, işi &uuml;stlenen firmadan bilahare tahsil edildiği,</p> <p style="text-align: justify;">4490 sayılı T&uuml;rk Uluslararası Gemi Sicili Kanununa tabi ve T&uuml;rk Uluslararası Gemi Siciline kayıtlı T&uuml;rk Bayraklı gemiler i&ccedil;in, kanunun 12.
